PSALMS CAPITAL, LLC IS NOT A LICENSED REAL ESTATE BROKERAGE, LICENSED REAL ESTATE AGENT, OR REGISTERED INVESTMENT ADVISOR (RIA) IN THE STATE OF SOUTH DAKOTA, FLORIDA, ILLINOIS, OR ANY OTHER JURISDICTION.
- We do not list properties for third parties on the MLS, represent buyers or sellers as a fiduciary agent, or charge real estate commissions.
- Any contracts we enter into are as principals, and any contract assignments are executed in our capacity as the equitable interest holder of the purchase and sale agreement.
- No information provided on our Site, in our marketing materials, or during our Services constitutes legal, tax, or financial advice. You are strictly advised to consult with your own legal counsel, accountants, and licensed professionals before executing any real estate or financial transactions.
SECTION 3: USER CONDUCT AND PROHIBITED ACTIVITIES

- Unsolicited Communications: Using our contact coordinates or company details to transmit spam, chain letters, or unsolicited B2B marketing.
SECTION 4: INTELLECTUAL PROPERTY RIGHTS
4.1 Ownership of Content
All content, design assets, text, proprietary analytical spreadsheets (including double-close settlement models), skip-traced lead matrices, strategic playbooks (including the Sovereign Asset Master Playbook and Pre-Auction Intercept Blueprint), software configurations, logos, and branding elements displayed on or associated with the Site are the exclusive intellectual property of Psalms Capital, LLC, protected under United States copyright, trademark, and proprietary trade secret laws.

Market conditions fluctuation, zoning regulations, municipal ordinances, title defects, and unforeseen property rehabilitation requirements can negatively impact asset yields. Past performance metrics do not guarantee future financial outcomes. You assume all risk for any underwriting decisions, acquisitions, or capital deployments you execute.
SECTION 6: LIMITATION OF LIABILITY
TO the maximum extent permitted by applicable law, in no event shall Psalms Capital, LLC, its managing members, officers, employees, registered agents, or affiliates be liable for any direct, indirect, incidental, special, exemplary, punitive, or consequential damages (including, but not limited to, loss of profits, lost data, business interruption, transaction failure, or escrow deposit forfeitures) arising out of, or in connection with:

- Any transaction, contract assignment, or joint venture entered into with us;
- Any delayed or failed communications via our automated SMS or email channels;
- Any reliance on real estate valuations, underwriting models, or marketing materials.
Our total aggregate liability to you for any and all claims arising under these Terms or your use of the Services shall not exceed one hundred United States dollars ($100.00).

This Section governs all SMS and MMS text messaging communications to and from Psalms Capital, LLC. Carriers and underwriters require these clauses to maintain our active, approved messaging campaigns.
7.1 Consent & Opt-In Framework
By completing any inquiry form on our Site (such as requesting a property valuation or submitting a seller inquiry), or by initiating an outbound text communication to our registered business lines, you explicitly consent to receive conversational, operational, and transactional SMS/MMS messages from Psalms Capital, LLC.

7.4 Opt-Out and Unsubscribing (STOP)
You may opt-out of receiving SMS/MMS messages from us at any time. To unsubscribe, simply reply STOP to any text message received from our Twilio or automated system numbers.
- Upon receiving your STOP command, we will send you a final, single confirmation message verifying that you have been unsubscribed from our SMS database.
- Following that confirmation, you will receive no further automated text messages from us unless you explicitly re-initiate consent.

WE DO NOT SHARE, SELL, LEASE, RENT, TRADE, OR DISCLOSE YOUR SMS CONSENT DATA, MOBILE NUMBERS, OR PERSONAL LEAD DETAILS TO ANY THIRD-PARTY MARKETING AGENCIES, OUTSIDE BROKERAGES, ISV RESELLERS, OR AFFILIATES FOR PROMOTIONAL PURPOSES.
- All information gathered through our text messaging channels remains strictly confidential within the secure, private systems of Psalms Capital, LLC.
- Personal information sharing is restricted solely to licensed escrow companies, title attorneys, or contractually-bound transactional lenders (such as FundSmart) directly required to execute and close your specific real estate transaction.
SECTION 9: INDEMNIFICATION
You agree to defend, indemnify, and hold harmless Psalms Capital, LLC, its managing members, registered agents, and employees from and against any and all claims, damages, liabilities, losses, costs, or expenses (including reasonable attorney fees) arising from:
- Your breach of these Terms;
- Your misuse of the Site, Services, or intellectual property;
- Any regulatory claims or telecom fines resulting from inaccurate phone numbers or false contact data you submit;
- Your performance or lack thereof under any purchase and sale contracts or joint venture agreements.
